Welcome to Smartikle. These Terms of Service ("Terms") govern your access to and use of Smartikle.com, our mobile apps, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a family, organization, or school, you agree to these Terms on its behalf.
Accounts are created and managed by adults — parents, guardians, tutors, teachers, or schools. You must be at least 18 years old, or the age of majority where you live, to create an account.
Children may use the Service only under the supervision and direction of a responsible adult who is accountable for their use. If you add learners to your account, you confirm you have the authority and any necessary consent to do so. See our Privacy Policy for how we handle children's and student data.
Smartikle provides short learning articles with quizzes, courses and assignments, progress tracking, and learning games, for families, tutors, homeschools, and schools. We may add, change, or remove features over time to improve the Service.
You are responsible for the information you provide, for activity under your account, and for keeping your login credentials secure. Notify us promptly at support@smartikle.com if you believe your account has been compromised.
You agree not to:
We may suspend or remove content or accounts that violate these rules.
You retain ownership of content you create or upload. You grant Smartikle a limited license to host, store, and display that content solely to operate and provide the Service to you.
We handle personal and learner data as described in our Privacy Policy, which is part of these Terms.
The Service, including Smartikle articles, quizzes, software, and branding, is owned by Smartikle or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended educational purpose. You may not copy, redistribute, or create derivative works from our content except as expressly allowed.
The Service relies on third-party providers (for example, hosting, payment processing via Stripe, and sign-in providers). Your use of those features may also be subject to the third party's terms. We are not responsible for third-party services we do not control.
The Service is provided "as is" and "as available." Smartikle is an educational aid and does not guarantee specific learning outcomes, academic results, or that content is error-free. To the fullest extent permitted by law, we disclaim warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Smartikle and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or other users. On termination, your right to use the Service ends; sections that by their nature should survive (such as intellectual property, disclaimers, and limitation of liability) will remain in effect.
We may update these Terms from time to time. Material changes will be posted on this page with an updated date, and where appropriate we will provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the jurisdiction in which Smartikle operates, without regard to conflict-of-laws rules. Any disputes will be handled in the courts of that jurisdiction, unless otherwise required by applicable law.
